General Information for Websites

Your Information

Every website I create is different, with a unique look, with tailored functionalities, and targeted at a specific market. So talk to me about what it is that you're after, and I'll be able to put together a concept and give you an idea on price. Any information you give me is confidential. And your website (Including Apps and services provided by Third Party Providers) will be secure & include encryption to ensure your information, and that of your customers, is secure.

I often deal with clients who prefer to keep details about their business or organization under wraps, whilst under development. You can be assured that your request for privacy will be respected.

Set Up Costs and Ongoing Costs

I can provide you with a no obligation quote which includes your domain registration and hosting plan options. I'll send you a breakdown of the costs involved, so you can see how affordable it can be to have an expertly built, beautiful website.

Search Engine Optimization (SEO)

A unique plan will be put in place so that your new website (and mobile version) will be fully optimized. I recommend updating your SEO on a regular basis, especially if you intend to edit and update the content on your website. While there are no guarantees your site will show on the top of the first page in Google search results, when done correctly, your website will be organically optimized, and in a short time you will see good results. Good optimization requires good quality content, image descriptions, key words & phrases and external links, and this is a major part in an website I build. It pays to get it right.

Google Business Tools

Google has a range of tools available to help improve your online presence. I encourage all my clients to take advantage of these, and can assist in setting up all your business needs.

Business Management Tools

You will have the ability to manage your business with tools available for customer management (contact list), finance (invoicing, quotes, options for payment), email marketing (create personalized email campaigns), social media integration, and the list goes on. I am available to talk you through which tools may suit your needs.

Content Management System (CMS)

Your website has a comprehensive CMS and I can show you how to use it effectively. You will receive training on this (allow 1 hour) as part of your website quote. Of course if you'd like me to manage your website on an ongoing basis, allowing you more time to work in your business, I'm happy to do so. This will be charged at a fixed hourly rate, and can be very cost effective.

14 Day Free Edits After Launch

This applies to all new website builds. Once I have completed your new website, you have signed it off and the site is ready to "go live", I will launch the website. I will send an invoice for the agreed amount (or balance of cost less deposit if one has been paid) to be paid in full within 7 days (unless otherwise agreed) If the site has been launched and both parties are aware that there will be additional images or content still to be supplied by the client (which is inclusive of the initial scope quoted for) OR if you require minor alterations to site content or layout, I will make these edits free of charge for a period of 14 days after launch. 

 

Please note this will not include the addition of multiple new pages, large amounts of new copy or editing images in Photoshop.

Terms & Conditions for Website & Graphic Design Services

 

Please note: Any requests for urgent work ("I need it right now" or "Can you do it today/tonight?") may be charged at the "Urgent Project Rate" depending on the circumstances and at my discretion.  Thanks for your understanding. Please see Office Hours on the contact page.

 

PROVISION OF GOODS AND SERVICES IS STRICTLY SUBJECT TO THE ACCEPTANCE OF THESE TERMS AND CONDITIONS AND UNLESS NOTIFIED OF NON-ACCEPTANCE IN WRITING THE CUSTOMER IS DEEMED TO HAVE ACCEPTED THESE TERMS AND CONDITIONS

1.Definitions
1.1“Seller” means Studio Blue Kaikoura or SBK (formerly known as Studio Blue Creative or "SBC")

1.2 “Customer” means the person, authorized agent or legal entity described in the application, or stated on the invoice or order form, buying goods and/or services from SBK

1.3 “Goods” has the same meaning as section 2 of the Sale of Goods Act 1908 and is any goods provided by the seller to the customer.

1.4 “Services” shall mean all services supplied by the seller to the customer and includes any recommendations or advice.

1.5 “Price” shall mean the purchase price of the goods and any other costs payable to the seller by the customer as indicated on the invoice.

2. Acceptance
2.1 Any instructions received by the seller from the customer for the supply of goods or services shall constitute acceptance of the terms and conditions contained herein.

2.2 No agent or representative of the seller is permitted to make any such agreements, representations, conditions or warranties not expressly confirmed by the seller in writing.

3. Services
3.1 The Company shall provide the Services as specified in the Quote or Estimate provided to the Client.

3.2 Where dates are given for the completion of the Services, these dates are stated in good faith but are not to be treated as a term of the contract.

3.3 If the provision of the services is delayed for any reason whatsoever, the Company shall not be responsible or liable in any way to the Client or any other party for any direct or indirect loss sustained due to such delay. Delay or failure to deliver by a set date does not entitle the Client to cancel any order or part thereof.

3.4 The Client may order variations to the Services in writing or may request the Company to submit proposals for variations to the Services at any time. If accepted, the variations will be included as part of the Services for the purpose of this Agreement.

4. Quotations & Estimates

4.1 Quotations & estimates are valid for 30 days, after that SBK reserves the right to amend quotes and estimates if necessary to allow for price variances.

4.2 Once accepted, the quotation or estimate becomes binding on both parties.

4.3 If for any reason after acceptance of the quotation or estimate, it is cancelled by the customer, SBK reserves the right to charge a fee commensurate to the time, effort and any other costs involved up to that time together with an allowance for lost opportunity.

4.4 SBK is not gst registered, therefore gst is not included in any quote or invoice. There may however be gst added to goods or services provided by third party suppliers or manufacturers.

4.5 SBK may use external suppliers for services such as printing, signage, website hosting, domain registration and email and may provide quotes or estimates on request. Any quote or estimate provided by such suppliers is subject to change without notice. SBK will endeavour to disclose any changes but is not liable for any discrepancy caused by such changes.

4.6 Any additional work undertaken over and above any supplied/accepted quote from SBK will be charged accordingly and may be either added to the original quote or separate.

5. Terms of Payment

5.1 Unless otherwise agreed, payment of the purchase price shall be paid to SBK within 7 days from the date of the invoice.

5.2 All projects will require a deposit and/or progress payments, if so this will be covered by our written quotation/estimate, and shall be paid within 7 days from the date of the invoice.

5.3 Optional: Payments can be made online using debit or credit card. A processing fee of 2.9% will be added to your invoice to cover additional bank fees incurred. Talk to me about using this option.

5.4 Any invoices not paid by the due date will incur interest of 6% which will be calculated monthly until the outstanding amount is paid. 

5.5  In the rare event of non payment any invoice not paid within 3 months will defer to a third party provider who will initiate the collection process.​

5.6 Recurring Payments - SBK can opt to set up a recurring invoice for payments due on a regular ongoing basis. This is particularly useful for ongoing design or website management packages.

5.7 Method of payment. Preferred method of payment is by direct credit. Invoices show details of the back account number. If other method of payment if preferred, an online credit card payment* can be arranged. *NB fee apply. Contact me to arrange this method.

6. Cancellation

6.1 The customer may cancel delivery of goods at SBK's sole discretion and will be liable for any costs incurred by SBK.

6.2 SBC may cancel these terms and conditions or cancel delivery of goods and services at any time before the goods are delivered by giving written notice. SBK shall not be liable for any loss or damage arising from such cancellation.

6.3 If a customer decides not to proceed with a project (see 6.1) and is liable for costs incurred by SBK, any offer of a discounted rate does not apply. Discounted rates are made in good will by SBK and only valid if the project is seen through to completion.

7. Force Majeure

7.1 SBK shall not be liable for failure or delay to perform its obligations if the delay or failure is beyond its control.

8. Non Waiver

8.1 Failure by SBK to enforce any of the terms & conditions contained in this contract shall not be deemed to be a waiver of any of the rights SBC has in this contract and is not liable for any indirect loss or expense to the customer.

9. Title

9.1 Title in the goods passes to the customer when the customer has made payment in full for all goods supplied by SBK.

10. Default

10.1 Where the customer is in default under these terms and conditions, or any other contract between the customer and the seller, the seller may:(a) Demand payment of all or part of any sums whether due or not; and/or (b) Require security for such obligations to its full satisfaction before any further supplies are made to the customer; and/or (c) Withhold without notice goods or services ordered by the customer; and/or (d) Cancel this or any other contract between the parties without prejudice to any rights of the seller to recover outstanding monies.

10.2 Without prejudice to its other remedies, the seller shall be entitled to cancel this and any other contract for goods or services with the customer in the following circumstances: (a) If the customer becomes insolvent or is adjudicated bankrupt; or (b) If a receiver is appointed in respect of the assets of the customer; or (c) If the customer no longer carries on business or threatens to cease carrying on business.

11. Pricing / Hourly Rate

11.1 SBK may quote a set fee for website design, and will provide the customer with a detailed breakdown of what is covered within the scope of any quote. This set fee may differ based on what is required for any particular "job" and will be discussed either during the initial consultation, or once a written quote is provided. 

11.2 SBK will charge a flat hourly rate of $80 P/H for all graphic design, signage, custom artwork.

11.3 SBK will charge a flat hourly rate of $50 per hour for any administration (over and beyond the initial fee quoted.) which includes website edits over and beyond the initial fee quoted; rectifying issues caused by non-payment of fees by the customer (which may result in suspension or cancellation of website hosting or email services by third party suppliers), updating customer details in regards to billing and payment details and the like.

11.4 SBK has a minimum fee of $30 which applies to ad hoc customer requests for (ie.) edits to websites; (printed or online) documents and forms; (printed or online) menus; locating and sending digital files (ie logos) or brand specifications to suppliers.

11.5 SBK reserves the right to amend these prices/rates at any time, without notice.

11.6 SBK is not registered for Goods & Services Tax (GST) 

No Obligation Quotes

I am happy to provide an estimate or written No Obligation Quote for Graphic Design, Signage or Website Design. As every project is different, please ensure you supply as much information as possible about what you require, so that I can provide an accurate quotation. An estimate is not a binding agreement.

As I work with third party suppliers, some costs quoted are subject to change without notice. I will endeavour to keep you informed of any changes as soon as possible if they as likely to affect the figure quoted.

If you require a detailed written quotation that requires coordination of costs from multiple sources, an administration fee will be charged (based on an hourly rate). 

Quotes are valid for 30 days from date of issue. Acceptance of a quote and payment of a deposit is required prior to any work being commenced.
